End User License Agreement

Important - Read Carefully - End-User License Agreement for Mobiliti, Laptop Software.
The End-User License Agreement ("EULA") is a legal agreement between you (the individual user or company) and Tacit Networks, Inc. for the IShared Mobiliti software. If you do not agree to the terms of the EULA, promptly return the unused SOFTWARE PRODUCT for a full refund.

SOFTWARE PRODUCT LICENSE
Copyright laws and international copyright treaties, as well as other intellectual property laws and treaties protect the SOFTWARE PRODUCT. The SOFTWARE PRODUCT is licensed, not sold.

GRANT OF LICENSE.
This EULA grants you the following rights:
You may use one copy of the Mobiliti Software Product on a single computer. The SOFTWARE is in "use" on a computer when it is loaded into temporary memory (i.e., RAM) or installed into permanent memory (e.g., hard disk, CD-ROM, or other storage device) of that computer. However, installation on a network server for the sole purpose of internal distribution to one or more other computer(s) shall not constitute "use" for which a separate license is required, provided you have a separate license for each computer to which the SOFTWARE is distributed.

Solely with respect to electronic documents included with the SOFTWARE, you may make an unlimited number of copies (either in hardcopy or electronic form), provided that such copies shall be used only for internal purposes and are not republished or distributed to any third party.

UPGRADES
If the SOFTWARE is an upgrade you may use or transfer the SOFTWARE only in conjunction with upgraded product

COPYRIGHT.
All title and copyrights in and to the SOFTWARE PRODUCT (including but not limited to any images, photographs, animations, video, audio, music, and text, incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by Tacit Networks, Inc. Copyright laws and international treaty provisions protect the SOFTWARE PRODUCT. Therefore, you must treat the SOFTWARE PRODUCT like any other copyrighted material except that you may either (a) make one copy of the SOFTWARE PRODUCT solely for backup or archival purposes or (b) install the SOFTWARE PRODUCT on a single computer provided you keep the original solely for backup or archival purposes.
DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS:
Limitations on Reverse Engineering, Decompilation, and Disassembly. You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
No Separation of Components. The SOFTWARE PRODUCT is licensed as a single product and neither the software programs making up the SOFTWARE PRODUCT or any UPDATE may be separated for use by more than one user at a time.

Rental: You may not rent or lease the SOFTWARE PRODUCT.

Software Transfer: You may permanently transfer all of your rights under this EULA, provided that you retain no copies, you transfer all of the SOFTWARE PRODUCT (including all component parts, the media and printed materials, any upgrades, this EULA, and, if applicable, the Certificate of Authenticity), and the recipient agrees to the terms of this EULA. If the SOFTWARE PRODUCT is an upgrade, any transfer must include all prior versions of the SOFTWARE PRODUCT.

Termination: Without prejudice to any other rights Tacit Networks, Inc. may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT.

LIMITED WARRANTY
THIS PROGRAM, INSTRUCTION MANUAL, AND REFERENCE MATERIALS ARE SOLD "AS IS,"
WITHOUT WARRANTY AS TO THEIR PERFORMANCE, MERCHANTABILITY, OR FITNESS FOR ANY PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THIS PROGRAM IS ASSUMED BY Y0U.

HOWEVER, TO THE ORIGINAL PURCHASER ONLY, THE PUBLISHER WARRANTS THE MAGNETIC DISKETTE OR CD-ROM ON WHICH THE PROGRAM IS RECORDED TO BE FREE FROM DEFECTS IN MATERIALS AND FAULTY WORKMANSHIP UNDER NORMAL USE FOR A PERIOD OF NINETY DAYS FROM THE DATE OF PURCHASE. IF DURING THIS NINETY-DAY PERIOD THE DISKETTE OR CD-ROM SHOULD BECOME DEFECTIVE, IT MAY BE RETURNED TO THE PUBLISHER FOR A REPLACEMENT WITHOUT CHARGE, PROVIDED YOU HAVE PREVIOUSLY SENT IN OUR LIMITED WARRANTY REGISTRATION CARD TO THE PUBLISHER OR SEND PROOF OF PURCHASE OF THE PROGRAM.

YOUR SOLE AND EXCLUSIVE REMEDY IN THE EVENT OF A DEFECT IS EXPRESSLY LIMITED TO REPLACEMENT OF THE DISKETTE OR CD-ROM AS PROVIDED ABOVE. IF FAILURE OF A DISKETTE OR CD-ROM HAS RESULTED FROM ACCIDENT OR ABUSE, THE PUBLISHER SHALL HAVE NO RESPONSIBILITY TO REPLACE THE DISKETTE OR CD-ROM UNDER THE TERMS OF THIS LIMITED WARRANTY.
ANY IMPLIED WARRANTIES RELATING TO THE DISKETTE OR CD-ROM, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO A PERIOD OF NINETY DAYS FROM DATE OF PURCHASE. PUBLISHER SHALL NOT BE LIABLE FOR INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OF THIS PRODUCT. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MIGHT NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.
